Highway Commission Loses Case to Condemn Land; Village Fremont
The proceedings to condemn the land in the Village of Fremont, owned by the Henry Borchardt, Sr., estate, took place before Judge Martin in county court on Tuesday. An effort was made to purchase the property without success, which necessitated this lawsuit. The Waupaca County Road Committee and Highway Commissioner Huffcutt appeared by District Attorney Olan, and the estate was represented by Attorneys L.D. Smith and John C. Hart. The proceedings started by the Highway Committee was objected to by the attorneys for the estate, for the reason that the statutory time limit had not been given the estate in which to answer. After the matter had been argued pro and con by the attorneys for both sides, Judge Martin determined the proceedings by granting the motion of the attorneys for the estate, which necessitated the payment of the costs by the Highway Commission. |
