CITY IN SUIT WITH WIFE OF CONGRESSMAN

COUNCIL AUTHORIZES MAYOR TO START CONDEMNATION PROCEEDINGS

TO ACQUIRE BROWNE TRACT

 

            At the regular meeting of the Common Council Tuesday evening the regular bills and pay rolls were read and authorized to be paid.

            The testimony taken before the Railroad Commission in the hearing of the petition of the Waupaca Electric Light company was received and placed on file after a discussion of the matter which may be found in another column of this issue.  The entire testimony may be seen at the office of the city clerk.

            The resolution fixing the salary of the various city employees was passed.  The salary of the different officers and employees is as follows:

                        Mayor                          $ 100.00 per year

                        Alderman                           50.00 per year

                        City Clerk                     1300.00 per year including all duties as secretary of Board of

Education, secretary of Board of Pubic Works, secretary of Board of Review and

secretary of Police and Fire Commission.

                        City Attorney                  300.00 per year

                        City Treasurer                 400.00 per year

                        Engineer                         750.00 per year

                        Supt. Water Works          750.00 per year

                                    Two offices being assumed by same person.

                        Man at Pumping Station per week, $25.00; extra man at Pumping Station, 25¢ per hour; teamster per month, $75.00; Chief of Police per year, $1200.00; Ward Police per hour, 30¢.

            The following petition from the Board of Directors of the Civic and Commerce Association was read:

To the Honorable Mayor and Common Council, City of Waupaca, Wisconsin.

Gentlemen:

            Whereas, Rose C. Browne is the owner of a tract of land bordering on the shores of Mirror and Shadow Lakes and abutting on the property now owned by the City of Waupaca, and known as South Park, and,

            Whereas, it appears to us to be of vital interest to the City and Citizens of Waupaca that this tract be acquired for park purposes to provide for the present and future needs of the city, and,

            Whereas, said Rose C. Browne has refused to sell said tract of land;

            Now Therefore, we, the Directors of the Civic and Common Association, do hereby respectfully petition your Honorable Body to institute on behalf of the City of Waupaca, proper and necessary proceedings for the condemnation of said tract of land for park purposes.

            Dated at Waupaca, Wisconsin, this 28th day of January, 1921.

            That the members of the Council heartily joined in the sentiment that promoted those who signed the petition is shown by the fact that the following resolution was immediately introduced and unanimously passed by the Common Council.

The Resolution

            Whereas, a majority of the electors of the City of Waupaca, Wisconsin, at an annual election held for that purpose, voted to acquire the lands hereinafter described for park purposes:

            And, Whereas, the Common Council of said City has been unable to acquire said lands either by gift or purchase;

            And, Whereas, the City Attorney, L.D. Smith, on account of his associations with the owner of said lands is not in a position to bring the necessary condemnation proceedings against said lands;

            Now Therefore, It Is Hereby Resolved, by the Mayor and Common Council of the City of Waupaca, Wisconsin, that said city proceed according to law to acquire said lands for park purposes, by condemnation.

            It Is Further Resolved, that counsel be employed to bring said condemnation proceedings, and that the May or of said city shall present a proper petition to the County Judge of Waupaca County, Wisconsin, praying that said lands be condemned for park purposes, and that a sufficient amount to pay the expenses of said condemnation proceedings be, and the same is hereby appropriated out of the General Fund of said City.

            The following is a description of said real estate, which is situated in the City of Waupaca, County of Waupaca and State of Wisconsin, to-wit:

            A tract or parcel of land commencing at the Southwest corner of South Park on Outlot One Hundred Fifty-six (156) of the President and Trustee’s Plat of the Village (now City) of Waupaca according to the recorded Plat thereof, and running thence West to the West Two rods, and this shall be the place of beginning; thence running East parallel with Junction Street to Mirror Lake, thence Southerly along shore of Mirror Lake to the center of the channel between Mirror Lake and Shadow Lake, thence Westerly along the shore of Shadow Lake to a point which would be intersected by the continuation of the West line of Main Street, continued Southerly, thence Northerly along the West line of Main Street, continued to place of beginning.

            Dated this 1st day of February, A.D. 1921.
