The Ability to Smell Moon Good in Lieu of Search Warrant

 

            If an officer can actually smell the liquor that is concealed in a car he has the right to search it without a search warrant, the supreme court held in a suit brought against Sheriff Edward C. Miller, LaCrosse.  The sheriff was sued because he searched a car without a search warrant and then confiscated the machine because he found liquor.  One of the cans containing liquor was leaking and it was the odor from this that the sheriff smelled.
